Part 1 - Release and Waiver of Liability

In consideration for being permitted to participate in any way in horse sport activities, I understand, acknowledge and accept that:
Effect of this Document
I have had sufficient opportunity to read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without inducement of any kind.
I understand that agreeing to the content of this document constitutes a complete and unconditional release of all liability of the Releasees, to the greatest extent allowed by law in the event of me and/or the children under my care, suffering injury or death.
FOR PARTICIPANTS OF MINORITY AGE (under 18 years) I, as a parent/guardian with legal responsibility for this participant, acknowledge, understand and accept the above and consent and agree to my minor child’s involvement or participation in horse sports activities.
Part 2 - Terms of Acceptance
Ballarat Pony Club is pleased to offer you access to our excellent facilities at the Victoria Park Equestrian Precinct. We hope you will enjoy riding at BPC and treat the grounds and equipment with due consideration, and in adherence with our terms.
The safety of riders, horses and onlookers is our primary concern:
Part 3 - Conditions of Use
Users must agree to the following conditions:
1. Payment
2. Availability
3. Supervision and accompanying persons
All users must always be accompanied by a responsibile adult (who may be a qualified instructor) who can supervise the training session and assist in the event of a medical emergency.
Every individual handling a horse anywhere on the grounds must:

Users agree to comply with PCAV or HRCAV or EV Gear and Rider safety equipment rules in relation to the use of correct riding tack and attire when handling horses on the Grounds.
6. Voluntary assumption of risk and waiver/indemnity
The Applicant has read and fully understood and accepts the Release and Waiver of Liability, the Terms of Acceptance and the Conditions outlined on this form and agrees to comply them.

In consideration for being permitted to participate in any way in horse sport activities, I understand, acknowledge and accept that:
- Horse sports are dangerous recreational activities and horses can act in a sudden and unpredictable way, especially if frightened or hurt
- There is a significant risk that serious INJURY or DEATH may result from horse sport activities
- I knowingly and freely assume all such risks, both known and unknown, and I VOLUNTARILY PARTICIPATE at my OWN RISK and assume sole responsibility for any injury, death or property damage I may suffer that arises from my participation in horse sport activities
- I understand and acknowledge the dangers associated with the consumption of alcohol or any mind-altering drugs before and during activities and I take full responsibility for any injury, loss of damage associated with their consumption.
- I agree not to drink alcohol or take any drugs prohibited by law before or during any horse sports activities
- I agree to follow the terms of my Facility User agreement and terms on the BPC website, and that any misconduct or refusal by me to follow any of these conditions can result in the CANCELLATION of my agreement with Ballarat Pony Club and my immediate removal from any horse NO MATTER where that may occur
- I understand that any such non-compliance may result in injury, death and/or permanent disability because of my failure to comply
- I agree to wear a helmet at all times whilst riding and agree that I am solely responsible for ensuring that I wear a helmet at all times whilst riding and take sole responsibility for my actions

- All riders must be accompanied by a responsible adult capable of managing an emergency
- Horses may not be left unattended overnight
- All riders must wear protective clothing with a minimum of accepted helmet and riding boots
- Close all external gates when horses are present on grounds
- Please be respectful of all other ground users, mounted or on foot
- Dog walkers are permitted to use the grounds – we expect mutual respect and appropriate animal management to minimise risk to either party
- Report any accidents or incidents to the Booking Officer
- Ride within the capabilities of you and your horse
- Horses must be cared for in accordance with guidelines set out by your club affiliation, common sense and proper attention to animal welfare guidelines
- Users are granted access on the understanding that grounds and equipment will be treated with respect and only used for their intended purpose
- Clean and put away all equipment after use
- Water is always available at the central trough in the car park area
- Leave horse yards clean and free of straw, manure and hay band
- Report any breakages, malfunctions or dangers to the Booking Officer
- Re-lock anything you unlocked
- Lunging of horses only permitted in the lunging yard
- Be considerate of the state of the ground, do not ride in boggy areas or cut-up take offs and landings to jumps
- Do not fill the water jump without prior agreement with the BPC Committee
- Do not use the big water jump if it does not contain water, damage may occur to the liner
- Do not try to access any bunted areas
- Inappropriate behaviour will result in forfeit of user privileges
Part 3 - Conditions of Use
Users must agree to the following conditions:
1. Payment
- The Annual Facility User payment is for a 12-month period
- The Day Facility User payment is for a twelve-hour period
- The User is provided the current gate combination and notification of changes via email
2. Availability
- Book each facility use through the booking calendar on www.ballaratponyclub.com.au
- You will receive email, text or phone confirmation of booking
- Bookings only accepted on days when VPEC is not exclusively booked for a rally or event
- Grounds may be closed at the discretion of the BPC committee – the booking calendar will reflect all ground closures
3. Supervision and accompanying persons
All users must always be accompanied by a responsibile adult (who may be a qualified instructor) who can supervise the training session and assist in the event of a medical emergency.
Every individual handling a horse anywhere on the grounds must:
- Be a current user (day or annual)
- and hold current PCAV, EV or HRCAV Insurance (or equivalent equestrian insurance)
- or be an immediate family (spouse/sibling/parent) member of a Ballarat Pony Club User
